About This Practice
This Site is operated by Lissa Dutton, LMFT, a Licensed Marriage and Family Therapist (LMFT #122200) based in Palo Alto, California. This Privacy Policy applies only to information collected through the Site. Information shared during therapy sessions is protected separately under HIPAA and California state law and is governed by my Notice of Privacy Practices, which is provided to all clients.
Collection of Personal Information
In order to better provide you with the services offered through this Site, I may collect personally identifiable information that you voluntarily share, such as your first and last name, email address, or phone number.
I do not collect any personal information about you unless you choose to provide it. You may be asked to provide certain information when you:
Submit a contact form or inquiry
Schedule a consultation or appointment
Sign up to receive emails or other communications
Reach out by email or phone
Information you provide is used to communicate with you about the services you have requested. Additional personal or non-personal information may be gathered in the future.
When you visit the Site, certain information is automatically collected about your device, including your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse the Site, I also collect information about the individual web pages you view, what websites or search terms referred you to the Site, and how you interact with the Site.

Communicating with Established Clients
If you are an established client, please communicate directly through your secure client portal (Simple Practice) rather than through the Site's contact form or email. Web forms and email are not fully secure and should not be used to share confidential clinical information.
Data Retention
Information you submit through the Site is retained for as long as needed to respond to your inquiry, provide the services you have requested, or comply with legal obligations. You may request deletion of your information at any time using the contact details below. Upon receipt of a verifiable request, I will:
Delete your personal information from my records
Direct any service providers to delete your personal information from their records
California Resident Privacy Rights
If you are a California resident, you have the right to:
Know what personal information is collected about you
Request access to the personal information held about you

Children Under Thirteen
This Site is not directed to children under the age of thirteen, and I do not knowingly collect personally identifiable information from children under the age of thirteen. If you are under thirteen, please ask a parent or guardian for permission before using this website.

Notice of Privacy Practices (HIPAA)
Clinical information shared during therapy is protected under HIPAA and California state law. A separate Notice of Privacy Practices, which describes how protected health information is used and disclosed, is provided to all clients before or at the start of therapy. This Privacy Policy applies only to information collected through the Site.
Medicare Policy
I have opted out of Medicare under §§1128, 1156, or 1892 of the Social Security Act. If you are eligible for Medicare and choose to work with me, you will be required to sign an Opt Out Private Contract. Signing this contract indicates an understanding that you (or your legal guardian or representative) will be solely responsible for all costs of treatment. Seeking services from a provider who has not opted out of Medicare may result in fewer out-of-pocket costs.
Your Rights and Protections Against Surprise Medical Bills
(OMB Control Number: 0938-1401)
When you receive emergency care or are treated by an out-of-network provider at an in-network hospital or ambulatory surgical center, you are protected from surprise billing or balance billing.
What is “balance billing” (sometimes called “surprise billing”)?
When you see a doctor or other health care provider, you may owe certain out-of-pocket costs, such as a copayment, coinsurance, and/or a deductible. You may have additional costs or be responsible for the entire bill if you see a provider or visit a health care facility that isn't in your health plan's network.
“Out-of-network” describes providers and facilities that haven't signed a contract with your health plan. Out-of-network providers may be permitted to bill you for the difference between what your plan agreed to pay and the full amount charged for a service. This is called “balance billing.” This amount is likely more than in-network costs for the same service and might not count toward your annual out-of-pocket limit.
“Surprise billing” is an unexpected balance bill. This can happen when you can't control who is involved in your care, like when you have an emergency or when you schedule a visit at an in-network facility but are unexpectedly treated by an out-of-network provider.
You are protected from balance billing for:
Emergency services.
If you have an emergency medical condition and receive emergency services from an out-of-network provider or facility, the most the provider or facility may bill you is your plan's in-network cost-sharing amount (such as copayments and coinsurance). You can't be balance billed for these emergency services. This includes services you may receive after you're in stable condition, unless you give written consent and waive your protections against balance billing for those post-stabilization services.
Certain services at an in-network hospital or ambulatory surgical center.
When you receive services from an in-network hospital or ambulatory surgical center, certain providers there may be out-of-network. In these cases, the most those providers may bill you is your plan's in-network cost-sharing amount. This applies to emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist, and intensivist services. These providers can't balance bill you and may not ask you to waive your protections.
If you receive other services at these in-network facilities, out-of-network providers can't balance bill you unless you give written consent and waive your protections.
You're never required to give up your protection from balance billing. You also aren't required to receive care out-of-network. You can choose a provider or facility in your plan's network.
When balance billing isn't allowed, you also have the following protections:
You are only responsible for paying your share of the cost (such as the copayments, coinsurance, and deductibles you would pay if the provider or facility were in-network). Your health plan will pay out-of-network providers and facilities directly.
Your health plan generally must:
Cover emergency services without requiring you to obtain prior authorization
Cover emergency services provided by out-of-network providers
Base what you owe the provider or facility (cost-sharing) on what it would pay an in-network provider or facility, and show that amount in your explanation of benefits
Count any amount you pay for emergency services or out-of-network services toward your in-network deductible and out-of-pocket limit
If you believe you've been wrongly billed, you may contact the California Department of Insurance.
